Contested Wills and Administration of Estates
We can advise clients on complex questions of testamentary capacity, the validity of Wills including whether certain documents may be considered valid informal Wills, and challenging Wills on other bases such as undue influence or duress (or defending such claims).
We can also assist beneficiaries of deceased estates where they are concerned an estate is not being property administered, for example where a beneficiary has had to wait a long time and has received little or no correspondence from an executor and still hasn’t received their distribution from an estate. This can involve assisting beneficiaries to require an executor to pass accounts either in common form or on the basis of wilful default or making an application in court to remove (and replace) a non-performing executor.
